Women on maternity leave on 1 Apr can avail new benefits

New Delhi: Who were already on maternity leave at the time of enforcement of the Maternity Benefit (Amendment) Bill, 2016, can avail of the enhanced maternity benefit.The Union government had notified the [pdf_attachment file=”1″ name=”Maternity Benefit (Amendment) Act, 2017,”] on 28 March this year. The provisions of the Act have come into force with effect from 1 April. The only provision still awaited is the one related to the crèche facility [Section 4(1)], which will apply 1 July onwards.

To many concerned, mothers, their husbands and employers included, it was not clear whether new and old seekers of the facility were subject to the same law. Responding to their queries, the Ministry of Labour & Employment issued certain clarifications on various provisions of Maternity Benefit (Amendment) Act, 2017, on 12 April.

The government has said that it is mandatory on the part of employers to extend the benefit of enhanced maternity leave to those women workers who were already on maternity leave on the date of enforcement of the amended law (1 April).
