Woman gang-raped on pretext of nikah halala after triple talaq

Awoman in Meerut, who wished to remarry after her husband gave her triple talaq, was allegedly gan-graped by two men on the pretext of nikah halala.

The victim, a resident of Lisari Gate Police station area of Meerut, was divorced under the now illegal practice of triple talaq six months ago. The man, who had allegedly pronounced triple talaq in anger, later regretted the decision and wished to remarry her.

However, a maulavi in the area asked the woman to first perform nikah halala.

Nikah halala is a practice under which a woman who wishes to remarry the man who gave her triple talaq, first has to get married to another man, consummate the marriage, get divorced, and observe a period of separation called ‘iddat’. Only after this can she marry her ex-husband.

The Meerut woman was asked to marry a man named Riyasat. On 24 October, the maulavi called both the woman and Riyasat to a hotel in TP Nagar area on the pretext of marrying them.

Riyasat allegedly called a friend, Umed, to the hotel as well, and both men raped the woman.

Later, the victim informed her brother about the ordeal, and he lodged a complaint with the police.

The police arrested both the accused, while search is on to locate the maulavi.

Meerut SP Vineet Bhatnagar said that the two suspects have been arrested, adding that the victim’s statement will be recorded under Section 164 of CrPC (Code of Criminal Procedure).

On 22 August 2017, the Indian deemed instant triple talaq (talaq-e-biddah) unconstitutional. Three of the five in the panel concurred that the practice of triple talaq is unconstitutional. The remaining two declared the practice to be constitutional. Three of India’s neighbouring countries Bangladesh and Sri Lanka are among the 23 countries worldwide that have banned triple talaq.
