In an interesting development, a petitioner has sought prosecution of Bill Gates, Serum Institute of India head Adar Poonawalla and government officials for AstraZeneca’s Covishield vaccine. Petitioner Kiran Yadav has technically sued the state through his criminal writ petition 18017 of 2021].
The petitioner alleges that the accused “murdered” a 23 year old man, who lost his life because of vaccination. The deceased took the Covishield vaccine, believing in the ‘false narrative’ that the vaccine was completely safe and also owing to the compliance requirement set by the Indian Railways that only double vaccinated people would be allowed to travel.
The union government’s Adverse Event Following Immunisation Committee had recently admitted that Dr Snehal Lunawat (23) died due to some side effects of the Covishield vaccine. The petitioner says the said report “exposed the falsity of the claim made by vaccine syndicate that vaccines are totally safe”, according to a report in a website of the Indian Bar Association.
The petitioner has demanded damages woth Rs 1,000 crore, of which the interim compensation would be of Rs 100 crore.
The report cites a case before a US court dealing with the side effects of MR vaccines, where the judge ordered compensation of $ 101 million to the victim. In another case in the said country, the American intelligence agency CIA recovered about $ 10.2 billion from pharmaceutical company GlaxoSmithKline for various offences including suppression of side effects of the medicines and putting the life of Americans in danger.
The judgment in Montgomery’s case  UKSC 11, Airdale NHS Trust Vs. Bland (1993) 1 All ER 821, Common Cause Vs. Union of India (2018) 5 SCC 1 and Registrar General Vs. State of Meghalaya 2021 SCC OnLineMegh 130 and also the Universal Declaration on Bioethics & Human Rights, 2005, makes it clear that before giving vaccine or any treatment to a person, he should be informed about the side effects of the medicine and also about the alternate remedies available.
If a person is vaccinated by suppressing the facts or by telling a lie that the said vaccines are completely safe, amount to the consent being obtained under deception. Based on the US legal position, the petitioner believes he would get justice in India! He asked for registration of an FIR under Sections 52, 115, 302, 409, 120(B), 420, 34, 109 etc. of IPC and section 51(b), 55 of the Disaster Management Act, 2005, against concerned officials who were marketing the vaccines as completely safe.
Bill Gates and Adar Poonawalla, the partners in manufacturing the Covishield (AstraZeneca) vaccine, as per the petitioner, have been named among the accused for their involvement in the “conspiracy”.
Is Gates guilty?
Several conspiracy theories have been floating around, targeting Bill Gates for years together. During the past two years of the global pandemic of Covid-19 caused by a China-origin virus, Gates has been called a “vaccine colonialist” and even a “vaccine monster”. But he is not the owner of AstraZeneca, unlike what the petitioner or the report citing the case claims.
According to The Guardian, in early 2020, Californian Catherine Gabitan bought a $ 199 lecture series from the self‑sabotage coach Jason Christoff. “Christoff, who also styles himself as a nutrition and exercise expert, shares misinformation about the Covid vaccine on his public Facebook page and his Telegram channel,” the newspaper says.
When contacted by The Guardian for comment, Christoff responded: “Maybe you should look into who sponsors your own newspaper, but that would get you sacked.” He subsequently wrote a blog linking the Guardian to a plot by the Bill and Melinda Gates Foundation to reduce the global population by 10-15%. “Is the Guardian and their sponsors watching out for public health or are they colluding to decrease population and public health, in order to place the remaining population under firm tyrannical control?” Christoff wrote.
That does not, of course, mean that Gates has a clean slate. A report says, “The pandemic has been good to Gates. In 2020, the Microsoft cofounder added $ 18-billion to his fortune, which now stands at a cool $ 131-billion (the annual GDP of Ethiopia, a country of 112-million people, is $ 96-billion)…”
The report above goes on to say, “… despite Gates’ stated commitment to an equitable distribution of the Covid vaccine, he is refusing to back South Africa and India’s calls for a waiver on patents.” This refers to the proposal by India and South Africa before the World Trade Organisation to let countries ignore all patents related to Covid-19 vaccines for the duration of the pandemic.
“His credentials as a philanthropist have taken a beating due to his views of Covid-19 vaccines, on which he has said that the vaccine technology should not be shared with developing countries even as people die around the world,” reported India Today.
That still does not make Bill Gates the owner of AstraZeneca, does it? The petition, which raises a serious issue, risks getting dismissed due to a careless or frivolous attribution or identification.
