The Central Administrative Tribunal (CAT), Lucknow Bench, today reserved its order regarding maintainability of the petition filed by activist Amitabh Thakur against the rapid transfer of Principal Secretaries of Home Department by the Government of Uttar Pradesh during the last few months.
The petition says that since 15 October 2013, 4 officers have occupied this post and they have been transferred within a few days, which is completely against Rule 7 of the IAS Cadre Rules 2014 that stipulates a minimum term of 2 years for all IAS officers and transfer before this period only in special circumstances, after having specified the reason for doing so.
Sudip Seth, counsel for the UP Government, opposed the petition by saying that Thakur is not an affected party because he has not been transferred while the latter said that the frequent transfer of principal secretary (home) was adversely affecting his service-related matters as an IPS officer.
Administrative Member Jayati Chandra reserved her order after hearing both the parties.
